Although this penalty was reduced to zero in 2019, some individuals may need to claim an exemption for other purposes.</span></li></ul><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><span style="font-size:13.5pt;">The updated affordability percentages are effective for taxable years and plan years beginning Jan. 1, 2021. This is a slight increase from the affordability contribution percentages in 2020. As a result, some employers may have additional flexibility in setting their employee contributions for 2021 to meet the adjusted percentage.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><b><span style="font-size:13.5pt;">Remote Verification of Form I-9 Documents Extended to Aug. 19</span></b></p><p></p><div style="text-align:left;"><span style="font-size:13.5pt;">The U.S. Department of Homeland Security (DHS) has&nbsp;</span><a href="https://www.ice.gov/news/releases/ice-announces-another-extension-i-9-compliance-flexibility-no-more-extensions" target="_blank" style="font-size:13.5pt;">announced</a><span style="font-size:13.5pt;">&nbsp;that the exemption for the physical inspection of&nbsp;</span><a href="https://www.uscis.gov/sites/default/files/document/forms/i-9-paper-version.pdf" target="_blank" style="font-size:13.5pt;">Form I-9 documents</a><span style="font-size:13.5pt;">&nbsp;has been extended to Aug. 19, 2020. According to the DHS, this will serve as the final extension.</span></div><div style="text-align:left;"><span style="font-size:18px;"><br></span></div>
<p></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><b><span style="font-size:13.5pt;">Physical Inspection</span></b></p><p style="text-align:left;"><span style="font-size:13.5pt;">Employers must complete and sign Section 2 of Form I-9 within three business days of the employee's first day of employment. Employers are required to physically examine the documents the employee presents from the list of acceptable documents to prove his or her employment&nbsp;eligibility.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><b><span style="font-size:13.5pt;">Remote Verification</span></b></p><p style="text-align:left;"><span style="font-size:13.5pt;">Because of&nbsp;<a href="https://www.cdc.gov/coronavirus/2019-ncov/index.html" target="_blank">COVID-19</a>, DHS is&nbsp;<a href="https://www.ice.gov/news/releases/dhs-announces-flexibility-requirements-related-form-i-9-compliance#wcm-survey-target-id" target="_blank">allowing</a>&nbsp;employers that are operating remotely to conduct a remote verification&nbsp;of approved I-9 documents. The exemption also applies to new hires affected by quarantine or lock down&nbsp;protocols. The exemption does not apply to employers that have employees physically present at a work location.</span></p><p></p><div style="text-align:left;"><span style="font-size:18px;"><br></span></div><div style="text-align:left;"><span style="font-size:18px;"><br></span></div>
<p></p><p style="text-align:left;"><span style="font-size:13.5pt;">Under the exemption, employers must complete a remote inspection of approved documents within three business days and enter &quot;COVID-19&quot; as the reason for the physical inspection delay. Employers that use this exemption must also keep written documentation of their remote on-boarding&nbsp;and telework&nbsp;policy for each employee.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><span style="font-size:13.5pt;">Within three days of when normal operations resume, all employees who were onboarded using remote verification must present their approved documents for a physical inspection. Employers should add &quot;documents physically examined&quot; with the date of inspection to affected I-9 forms.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><b><span style="font-size:13.5pt;">Determining Whether a COVID-19 Case Is Work-Related</span></b></p><p style="text-align:left;"><span style="font-size:13.5pt;">Even as businesses reopen and employees return to their new normal, the risk of becoming exposed to and ill with COVID-19 is still present. When an employee reports they have COVID-19, employers are faced with the difficult task of determining whether the employee's illness is work-related.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><span style="font-size:13.5pt;">As is the case with all inherently legal issues, employers are strongly recommended to seek the&nbsp;guidance of legal counsel when faced with these sorts of situations.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><b><span style="font-size:13.5pt;">OSHA Guidance on Work-Relatedness</span></b></p><p style="text-align:left;"><span style="font-size:13.5pt;">An injury or illness is work-related if an event or exposure in the work environment either caused or contributed to the resulting condition or significantly aggravated a preexisting injury or illness. Work-relatedness is presumed for events or exposures in the work environment.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><span style="font-size:13.5pt;">Unfortunately, because the coronavirus is so widespread, determining whether an employee's&nbsp;illness is work-related can be difficult and should be evaluated on a case-by-case basis.</span></p><p style="text-align:left;"><span style="font-size:11.5pt;">&nbsp;</span></p><p style="text-align:left;"><span style="font-size:13.5pt;">Employers should ask probing questions to reveal the potential exposure of COVID-19 in their workplaces. Employers should consult with legal counsel if they are concerned about what kinds of questions they may ask. <div style="text-align:left;"><span style="font-size:18px;"><span style="font-weight:800;">Federal Judge Upholds Hospital Transparency Rule</span></span></div><span style="font-size:18px;"><div style="text-align:left;"> On Thursday, June 23, 2020, District Judge Carl Nichols ruled in favor of the Trump administration's final rule requiring hospitals to disclose their negotiated prices. The rule was released on Nov. 15, 2019, and set to take effect Jan. 1, 2021. </div>
<div><div style="text-align:left;"><br></div><div style="text-align:left;"> However, in December 2019, the American Hospital Association (AHA) filed a lawsuit attempting to block the rule's implementation, stating that the requirement to disclose negotiated prices violated their First amendment rights. </div>
</div><div style="text-align:left;"><br></div><div style="text-align:left;"> Nichols ruled that it was within the Department of Health and Human Services' (HHS) scope to require the disclosure of these negotiated rates, rejecting the AHA's claims. </div>
</span></div><span style="font-size:18px;"><div style="text-align:left;"><br></div>
<div style="text-align:left;"><span style="font-style:italic;">What's included in the final rule? </span></div>
<div style="text-align:left;"> Hospitals will be required to provide easily accessible billing information to patients. This means having all standard charges available online and in one single data file that can be &quot;read by other computer systems,&quot; according to a Centers for Medicare &amp; Medicaid Services (CMS) press release. </div>
</span></div><span style="font-size:18px;"><div style="text-align:left;"><br></div>
<div style="text-align:left;"> The charges listed would include &quot;the gross charges, payer-specific negotiated charges, the amount the hospital is willing to accept in cash from a patient, and the minimum and maximum negotiated charges,&quot; according to the initial press release about the final rule. </div>
<div style="text-align:left;"><br></div><div style="text-align:left;"> As part of the final rule, CMS was granted more authority over enforcement. Specifically, the department has greater capability to audit hospitals and issue fines of $300 per day to those who are noncompliant.&nbsp; </div>
<div style="text-align:left;"><br></div><div style="text-align:left;"><span style="font-style:italic;">What's next? </span></div>
<div style="text-align:left;"> The rule won't be in effect until Jan. 1, 2021. In that time, hospitals will be working to make the applicable data available online, if it isn't already the AHA is expected to appeal the ruling, which could potentially delay the rule's effective date. </div>

Choose one platform and stick to it. After attendees download the platform once, it'll be easier to join the meetings later.</li><li style="text-align:left;">Create an agenda - Attendees may have a full calendar, so be clear on the purpose of the meeting and provide a timed agenda with topics and assigned facilitators. This will help invitees decide their attendance if they have multiple meetings at teh same time. Share this pre-work at least 48 hours in advance.&nbsp;</li><li style="text-align:left;">Establish ground rules - It might be helpful to have an agreed way of working, such as stating your name before talking or muting when not speaking. This helps keep the meeting efficient and remove distractions.<br></li><li style="text-align:left;">Test the technology - It's important to join the meeting at least five minutes early to test your connection, microphone and video.</li><li style="text-align:left;">Look professional - If using video, present yourself with appropriate grooming, hygiene and attire. That means mirroring what you would wear in person and keeping in mind whether it's an internal or external meeting.</li></ul><div style="text-align:left;"><br></div>

<div style="text-align:left;"><div>On June 8, 2020, the IRS issued <a href="https://www.irs.gov/pub/irs-drop/n-20-44.pdf" title="Notice 2020-44" rel="">Notice 2020-44</a>, which increases the <a href="https://www.irs.gov/newsroom/patient-centered-outcomes-research-institute-fee" title="Patient-Centered Outcomes Research Institute (PCORI) fee" rel="">Patient-Centered Outcomes Research Institute (PCORI) fee</a> amount for plan years ending on or after Oct. 1, 2019, and before Oct. 1, 2020. It also provides transition relief for calculating the average number of lives covered under the plan for this period (which is what the PCORI fee is based on).&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;</div></div>
<div style="text-align:left;"><br></div><div style="text-align:left;"> Specifically, the PCORI fee amount for plan years ending on or after Oct. 1, 2019 and before Oct. 1, 2020, is increased to $2.54 multiplied by the average number of lives covered under the plan. Plan sponsors may use any reasonable method for calculating the average number of covered lives for this period, in addition to existing methods, so long as it is applied consistently for the duration of the plan year.&nbsp; </div>
<div style="text-align:left;"><br></div><div style="text-align:left;"> As a reminder, employers of <a href="https://www.irs.gov/newsroom/application-of-the-patient-centered-outcomes-research-trust-fund-fee-to-common-types-of-health-coverage-or-arrangements" title="certain self-insured health plans" rel="">certain self-insured health plans</a> are responsible for paying PCORI fees annually. Fees for plan years that ended in 2019 at due July 31, 2020. </div>
<div style="text-align:left;"><br></div><div style="text-align:left;"><span style="font-weight:700;">DOL Proposes Updates to Mental Health Parity Self-Compliance Tool</span><span style="font-weight:700;"></span></div>
<div style="text-align:left;"><div><a href="https://www.dol.gov/" title="The Department of Labor (DOL)" rel="">The Department of Labor (DOL)</a> has proposed updates to a self-compliance tool to help improve compliance with <a href="https://www.cms.gov/CCIIO/Programs-and-Initiatives/Other-Insurance-Protections/mhpaea_factsheet" title="Mental Health Parity and Addiction Equity Act (MHPAEA)" rel="">Mental Health Parity and Addiction Equity Act (MHPAEA)</a>. The MHPAEA requires parity between a group health plan's mental health and substance use disorder (MH/SUD) benefits and medical and surgical benefits.&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;</div></div>
<div style="text-align:left;"><br></div><div style="text-align:left;"> Federal law directs the DOL to make a document publicly available&nbsp; to improve compliance with MHPAEA, and to update this document every two years. The DOL last updated the MHPAEA self-compliance tool in April 2018. The proposed updates to the self-compliance tool include: </div>
